Terms of Service for mojapteczka.pl

1. General Provisions

These Terms of Service set out the rules for using the mojapteczka.pl online service (referred to below as the "Service").
The Service enables users to manage their home medicine cabinet — including scanning medicines, storing medicine information, and monitoring expiry dates.
The owner and administrator of the Service is:

(referred to below as the "Administrator").

2. Definitions

User — a natural person who uses the Service after signing in with a Google account, Facebook account, or an email address and password.
Account — an individual User account created automatically upon the first sign-in.
Medicine — an entry in the User's inventory describing a medicinal product or dietary supplement.
Service — the features provided through the Service, including scanning medicine packaging, managing the inventory, and notifications about upcoming expiry dates.
Consumer — a User who is a natural person entering into a contract with the Administrator that is not directly connected with their business or professional activity.
Plan — the subscription tier selected by the User (Free, Standard, or Pro) defining available limits and features.

3. Conditions of Use

Using the Service requires signing in with a Google account (OAuth 2.0), a Facebook account (Facebook Login), or an email address and password, handled by Amazon Cognito.
The User agrees to use the Service in line with its intended purpose and applicable law.
The following are prohibited:
- using the Service for unlawful purposes,
- attempting unauthorised access to the Service's systems,
- entering false or misleading data.

4. Registration and Sign-In

Registration takes place automatically upon the first sign-in with a Google account, Facebook account, or email address.
The Administrator does not store the passwords of Users who sign in via Google or Facebook — authentication is handled through Google OAuth 2.0 or Facebook Login. Passwords of Users who sign in via email are securely stored by Amazon Cognito.
The User is responsible for the security of their login credentials.

5. Service Features

Medicine scanning — the User can take a photo of medicine packaging; the image is analysed by a vision-language model (VLM) to automatically read the name, dose, and other data.
Medicine inventory — storing and browsing the list of medicines assigned to the User and family members.
Expiry date monitoring — notifications about medicines approaching their expiry date or already expired.
Alternative search — viewing medicines with a similar active ingredient.
The services are provided electronically within the meaning of the Polish Act of 18 July 2002 on the Provision of Electronic Services. Service delivery time: immediately after signing in and selecting a plan.

6. Plans, Pricing, and Payments

The Service offers three subscription plans:
- Free — 0 zł / month (up to 20 medicines, 1 home medicine cabinet, 3 AI scans / month),
- Standard — 9,99 zł / month (up to 30 medicines, 3 home medicine cabinets, unlimited AI scans),
- Pro — 19,99 zł / month (up to 90 medicines, 5 home medicine cabinets, unlimited AI scans).
All prices are in Polish złoty (PLN) and include VAT.

The fee for the Standard and Pro plans is charged in advance for a one-month period.
The Administrator reserves the right to change plan prices with at least 30 days' notice. A price change does not affect a billing period that has already been paid for.

6.1. Payment Methods

Payments for the Standard and Pro plans are processed through Przelewy24.
Available payment methods: BLIK and quick online bank transfers.
Payment is transferred to the Administrator after successful authorisation by the payment operator.
For recurring payments (BLIK), the User consents to automatic charging in subsequent billing periods. The User may cancel the subscription at any time — recurring payments will stop at the end of the current billing period.

6.2. Service Delivery

The Service is provided electronically and is available immediately upon payment confirmation.
Plan activation is automatic — no further action is required from the User.
The Service does not involve the delivery of physical goods.

7. Right of Withdrawal

The Consumer has the right to withdraw from the contract within 14 days from the date the contract is concluded (activation of a paid plan), without giving any reason.
To exercise the right of withdrawal, the Consumer should submit a clear statement by email to: kontakt@mojapteczka.pl.
In the event of withdrawal, the Administrator will refund all payments received from the Consumer without undue delay, and no later than 14 days from the date the withdrawal statement is received, using the same payment method used by the Consumer.
Template withdrawal statement:

I, [first and last name], hereby give notice of my withdrawal from the contract for the provision of the mojapteczka.pl service (plan [Standard/Pro]), concluded on [activation date]. Account email address: [email address].
If the Consumer asks for the services to begin before the withdrawal period expires, the Consumer is obliged to pay an amount proportional to the services provided up to the point when they give notice of withdrawal.

8. Complaints

The User may submit a complaint regarding the operation of the Service by email to: kontakt@mojapteczka.pl.
A complaint should include:
- the User's contact details (name, email address),
- a description of the issue,
- the expected resolution.
The Administrator will process the complaint within 14 days of receipt and inform the User of the outcome by email.
The Consumer may use out-of-court complaint handling and redress procedures, including via the ODR platform: https://ec.europa.eu/consumers/odr.

9. Personal Data Protection

Users' personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

10. Liability

The Service is for informational purposes only and does not constitute medical or pharmaceutical advice.
The User should not make health decisions based solely on information from the Service.
The Administrator is not liable for:
- errors in automatic medicine recognition by the VLM model,
- outdated data in the Register of Medicinal Products,
- decisions made by the User based on data from the Service.

11. Service Availability

The Administrator makes reasonable efforts to ensure uninterrupted availability of the Service, but does not guarantee its continuous availability.
The Administrator reserves the right to temporarily disable the Service for maintenance or updates.

12. Advertisements

Users on the Free plan may be shown advertisements served by Google AdSense.
Advertisements are displayed only after obtaining the User's GDPR-compliant consent through the Cookiebot consent management platform (CMP).
Health and medicine data stored in the User's account is never shared with ad networks.
The User may withdraw consent to advertisements at any time in the application settings (Settings → Privacy).
Moving to a paid plan (Standard or Pro) removes all advertisements.
The Administrator is not responsible for the content of advertisements displayed by Google AdSense.

13. Changes to the Terms of Service

The Administrator reserves the right to amend these Terms of Service.
Users will be notified of changes through the Service with at least 14 days' notice.
Continued use of the Service after the changes take effect constitutes acceptance of the new Terms of Service.
